What are the most common accident claims?

We all know that accidents can happen unexpectedly, at any time and in any place. We're experienced in dealing with incidents of all types, but the majority of accident claims that people come to us for, tend to happen in the following circumstances:

Road traffic accident claims

According to figures from the Department for Transport,157,630 people were injured in UK road traffic accidents during 2019. We deal with accident claims for all types of road traffic injury. Whether you've been hurt in a car, on a motorbike or on a bicycle, we may be able to help you. We also handle passenger, pillion and pedestrian cases, including those involving commercial vehicles, public transport, hit and run incidents, and uninsured or untraceable drivers.

Workplace accident claims

There are several common causes of workplace injuries. These include unsafe working processes and inadequate personal protection or training. Weak risk assessments, preventable spillages, bad ventilation or poorly maintained equipment are also to blame for many work-related injuries.

If you've been injured at work, you're not alone. The Labour Force Survey revealed that there were581,000 incidents of self-reported workplace injuries in 2018-19. Plus, there were more than 69,000 injuries reported by employers under the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations (RIDDOR) in the same period. RIDDOR is part of the Health and Safety at Work etc Act 1974 and was introduced in 2013.

If you've been injured or contracted an occupational illness or disease at work, you could be entitled to make an accident claim.

Accident claims for injuries in public

We deal with accident claims for all types of slips, trips and falls in public areas or on premises. Common causes of these include spillages, slippery floors, broken or raised paving, uneven surfaces, potholes, poor lighting, bad signage and broken steps, banisters or railings. Injuries can range from minor but painful soft tissue damage to serious spinal, neck and head trauma that can be life-changing. So, if you've been injured in a public place and it wasn't your fault, we may be able to help you claim for the accident and receive the compensation you deserve.

How much compensation could I receive when I claim for an accident?

This is a very common question - and it's an important one to ask. All accident claims are different, which is why there's no simple answer.

The amount of compensation you could be entitled to depends on a number of factors, including the severity of your injuries and recovery time as well as any financial losses you may have suffered.

The Judicial College is part of the Ministry of Justice and it sets the guidelines for how much compensation you could be awarded for all types of personal injury. We use them to help value your accident claim, but they are just for guidance. The final damages you could be awarded will depend on your injury circumstances. We'll thoroughly investigate and then value your accident claim as we build your case.

Can I make a no win no fee accident claim?

Yes, you can make a no win no fee claim with us. This means that there aren't any hidden costs that you have to pay. Your solicitor may need to take out special legal protection insurance for you, which pays the costs if your claim fails, and ensures claiming is risk free. The cost of this is only taken if you win your case.  You'll never have to pay anything upfront and there are no hidden charges, so you'll never be out of pocket. We'll check to see if you do have appropriate legal protection insurance and if you don't, we'll arrange it for you.

If you win your claim, your solicitor will typically make the following deductions from the compensation you are awarded:

  • A ‘success fee' for winning the claim.
  • The other side will usually be required to make a payment towards your legal costs -  and expenses but any shortfall may also be deducted from your compensation.
  • The cost of the premium for any legal protection insurance you may have needed to ensure your claim is risk free.

You keep the rest and this will always be the majority of the compensation awarded to you. The deductions we list above will only be made when your compensation is paid. There are no upfront costs and no hidden charges.

We understand that claiming for an accident is likely the last thing on your mind. It's the main reason why we've turned making an accident claim into the hassle-free experience it should be.

Is there a time limit when claiming for an accident?

Yes, there is a time limit. In most cases, you can make an accident claim up to three years after the incident happened. If you were under 18 at the time of your injury, you have three years from your 18th birthday until your 21st to claim for an accident.

If you have suffered a serious brain injury that has compromised your psychological functions and you cannot therefore claim personally as a result, there are no time limits on a claim.

Should the three-year deadline be coming up, please get in touch with us on as soon as possible so that we can still help you.
